Puppy Sales Agreement This contract is between Cindy Allen herein after referred to as “Seller” and _____________________________________, herein after referred to as “buyer”. In consideration of payment in full of the purchase price of ______________ dollars by Buyer to Seller agrees to transfer to Buyer, subject to the terms and conditions contained in this contract, the ownership of one MALE/FEMALE, ______________________ puppy, herein after referred to as the “Puppy” (regardless of age), from the mating of the sire and dam identified below. Sire:________________________________ Dam:_____________________________ Buyer MUST have new puppy examined by a licensed veterinarian WITHIN 3 working days of taking possession of the puppy to ensure yourself you received a healthy puppy. The Seller guarantees that the said puppy will be free of distemper and parvo virus for a period of 3 (three) calendar days after receipt of the live puppy. The incubation period (time from contracting the virus to showing signs) for these viruses can be as low a 2 days. Any time you take your puppy some where (even the vet office!), your puppy has a chance of contracting the viruses so be cautious. The Seller will provide a vaccination record. If the puppy is due for vaccination, and the Buyer fails to provide vaccination on that day, this guarantee is null and void if the puppy contracts diseases that would otherwise be prevented by those vaccinations. The Seller shall not be responsible for any medical costs incidental to the puppy after Buyer receives the puppy. Seller guarantees the said puppy to be healthy at the time of sale. Seller does not assume any liability for any injury to said puppy after time of sale. If there is a problem with the puppy, Seller’s veterinarian and Buyer veterinarian must agree upon health reasons existed before time of purchase, provided the puppy has been properly cared for by the buyer. If the puppy dies within 1 (one) year of birth, Buyer MUST have an autopsy performed by a licensed veterinarian at Buyer expense to determine cause of death. If cause of death is due to a genetic problem and after Seller’s veterinarian has examined the puppy/results, a replacement puppy will be given as soon as one is available. Seller will not be responsible for any shipping cost to acquire the puppy. A replacement will only take place if the above puppy has been properly cared for by the Buyer. ***UNDER NO CIRCUMSTANCES WILL THE REPLACEMENT OF A PUPPY TAKE PLACE IF THE ABOVE CONDITIONS ARE NOT MET.*** Seller is NOT responsible for immunity level, mites, pneumonia, mange (sarcoptic or localized demodex), heatstroke, ringworm, hot spots, puppy acne, coccidiosis, conjunctivitis, fleas, ticks, and ear infections once puppy has left Sellers possession. These conditions are to be expected when owning a puppy. ** Generalized demodex WILL be covered.** Seller is NOT responsible for common growth problems known in the Great Dane breed ex: panosteitis (growing pains), Hypertrophic 0steodystrophy (HOD), Carpel Flexural Deformity (knuckling over), osteochrondrondritis dissecans (OCD) as these are problems due to improper/poor nutrition and overfeeding. Seller is NOT responsible for cherry eye, haw eye and bloat as these conditions are not genetic. Buyer agrees to provide super high quality food for the said puppy to help ensure a healthy life. Buyer has been informed by the Seller about what a super high quality food consists of. Buyer agrees to NOT over feed the said puppy to prevent common growth problems that can occur in Great Danes. Seller has made it very clear to the Buyer that if ever a concern or problem whether it be life threatening or not should arise with said puppy then they should and are welcome to contact Seller by phone or email. If the Buyer prefers commercial shipment: The Seller will arrange air shipment for the said puppy, however, the Buyer will pay the cost of any and all arrangements and expenses for commercial shipment of the said puppy. The Seller shall not be responsible for the safety of the puppy while in transit to the Buyer, to include any and all incurred injuries as a result of transportation accidents. Buyer agrees to provide all vaccinations and vet checks that may be needed to ensure a healthy life upon request of Seller. No replacement for temperament as this is environmental and Buyer responsibility. Seller is not responsible for any damage the puppy might do at any age. Seller guarantees your puppy to be free of any congenital anomalies for a period of 1 (one) year. If the said puppy happens to have some form of life threatening congenital defect or a congenital defect that prevents the puppy from living a healthy pain free life, there will be 2 (two) options the Buyer will have and they are as follows: A replacement puppy will be given of the same value or the Seller will pay the medical cost for the defect up to the total cost of the purchase price not to include any money paid for shipping of the puppy. Buyer MUST provide the Seller with any and all documents from the veterinarian that claims the defect so seller’s veterinarian can review them. In the event the Buyer wants a replacement puppy and if there are none available at the time, the Buyer will receive a puppy from the next available litter. This guarantee is NON-TRANSFERABLE. This contract contains the entire agreement between the parties and no statement or verbal agreements made by either party that are not contained in this written contract shall be valid or binding. This contract may not be modified or altered except in writing and signed by both parties. Violations of this contract will constitute BREACH OF CONTRACT. I have read and understand the stipulations of the contract and voluntarily agree to all elements, stipulations and provisions herein.
